1. Agreement

These Terms of Service ("Terms") are an agreement between you and Italian Paws LLC, 11 Parkway Center, Suite 365, Pittsburgh, PA 15220 ("Italian Paws," "we," "us"). They govern your use of shop.italianpaws.com (the "Shop") and every order or pre-order you place there. Our Refund Policy, Shipping Policy and Privacy Policy are part of these Terms. By using the Shop or placing an order, you agree to these Terms. If you do not agree, do not use the Shop.

2. Eligibility

You must be at least 18 years old, able to form a binding contract, and ordering for delivery to an address in the 48 contiguous United States or Washington, DC.

3. Our products and how to use them

Italian Paws products are supplements for dogs only and are not for human use. They are not intended to diagnose, treat, cure or prevent any disease. Read and follow the label before use. Consult your veterinarian before giving any supplement, especially if your dog is pregnant, nursing, taking medication or under veterinary care, and stop use and contact your veterinarian if your dog shows any unexpected reaction. Keep out of reach of children and other animals.

We aim to describe and display products accurately, but images are illustrations and minor differences may occur. The label on the product you receive controls.

4. Pre-orders and authorization to charge

By placing a pre-order, you authorize Italian Paws and its payment processor to save your payment method and to charge it, once, for the order total shown at checkout (products, shipping and applicable sales tax) when your order ships. The expected ship date is shown before you order. You may cancel at any time before your order ships, at no charge, by emailing info@italianpaws.com, which also withdraws this authorization. If we cannot ship by the expected date, we will notify you as described in our Shipping Policy. If your payment method is declined when your order ships, we will email you to update it; if it is not updated within 7 days, we may cancel your order.

5. Orders, acceptance and pricing

Your order is an offer to buy. Our order confirmation email confirms that we received your order; it is not an acceptance. We accept your order when we ship it. We may refuse, limit or cancel any order before acceptance, including if a product is unavailable, a price or description contains an error, we suspect fraud or unauthorized resale, or the delivery address is outside our shipping area. If we cancel an order after charging you, we will refund the full amount charged. Prices are in US dollars and may change, but a change will not affect an order already accepted.

6. Shipping, title and risk of loss

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when the order is delivered to the shipping address you provided.

7. Returns and refunds

Returns, cancellations and refunds are governed by our Refund Policy.

8. Electronic communications

You agree that we may communicate with you electronically, including by email, about your orders and these Terms, and that electronic notices satisfy any requirement that they be in writing.

9. Intellectual property

The Shop's content, including text, images, logos, the Italian Paws name, product names and designs, belongs to Italian Paws or its licensors and is protected by law. You may not copy, modify or use it for commercial purposes without our written permission.

10. Acceptable use

You agree not to use the Shop for any unlawful purpose, interfere with its security or operation, use automated means to access it, or buy products for commercial resale.

11. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND TO THE EXTENT PERMITTED BY LAW, THE SHOP AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the exclusion of implied warranties, so some or all of this section may not apply to you.

12. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, ITALIAN PAWS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SHOP OR OUR PRODUCTS, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. These limits do not apply to liability that cannot be limited or excluded by law, including liability for our gross negligence, willful misconduct or fraud. Some states do not allow these limitations, so they may not apply to you.

13. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as supplier or carrier disruptions, customs or regulatory holds, natural disasters or government action. If such an event delays your order, we will notify you and you may cancel at no charge.

14. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Subject to any non-waivable rights you have under the law of the state where you live, any dispute will be resolved in the state or federal courts located in Allegheny County, Pennsylvania, and you and we consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms by posting a new version on the Shop. The version in effect when you place an order applies to that order.

16. General

These Terms, with the policies they reference, are the entire agreement between you and us about the Shop. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor business.

17. Notice to California residents

Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
